Your use of the Website constitutes agreement to its terms and conditions. This Privacy Policy does not cover information collected on sites linked to from the Website.
COLLECTION AND USE OF PERSONAL INFORMATION
A user may visit the Website without revealing any personal information; however, Parkland collects personal information from you (for example, your name, postal address, email address, and other data) when you provide personal data through our Website. The Website generally collects personally identifying information with your specific knowledge and consent. For instance, you may be asked to provide information such as your email address, name or phone number when you sign up for our newsletter or use certain services provided by Parkland including, without limitation, the SOAR to Strategic Excellence™ software program and related programs (“SOAR”). Parkland will use this information to reply to your inquiries, to provide requested products and services, to set up accounts, and to contact individuals regarding new products and services. Further, if Parkland has entered into a licensing agreement for the licensing of SOAR with an individual or a company (a “Licensee”), Parkland will require and retain information on the Licensee. For purposes of this Privacy Policy, a Licensee that is a company includes individuals authorized by the company to utilize SOAR such as employee, sub-contractor, independent contractor, director, advisor or consultant (an “Individual”). The information required and retained would include the Licensee’s name, address, phone and email contact information; the Individual’s name, business address, phone and email contact information; information regarding the Licensee’s clients including name, address, nature of business, approximate annual sales range, industry, SOAR scores and related answers to SOAR questions, participant evaluations and comments, the complete SOAR report for that client, and any other information specifically required by the Website, as may be amended from time to time. All information collected by Parkland is protected under the Confidentiality Agreement entered into between each Licensee and Parkland, as well as between each Licensee and its clients who participate in a SOAR session.
THIRD PARTY ACCESS
We also allow access to our database by third parties that provide us with services, such as technical maintenance and search software, but only for the purpose of and to the extent necessary to provide those services. If you choose to purchase items through features on our Website, we may forward your information to third parties for services such as credit card processing and order fulfillment. Parkland does not bear any responsibility for any actions or policies of third parties. There also may be occasion when we are legally required to provide access to our database in order to cooperate with investigations or other legal proceedings. In those instances, the information is provided only for that purpose. Parkland utilizes information about Licensees and their clients to (i) customize the on-screen presentation of SOAR, (ii) customize the SOAR report for presentation to clients, (iii) validate the eligibility of users of SOAR, (iii) determine if users are encountering difficulties, and (iv) determine how many SOAR sessions have been conducted. Parkland utilizes the information obtained from the SOAR scores, including limited information about Licensee’s client’s industry, size and number of employees, to (a) more fully develop a profile of companies utilizing SOAR, (b) determine statistical averages for industries and sizes of companies, and (c) develop overall impressions based on an increasing number of SOAR events. Parkland utilizes the information contained in the SOAR report to assist facilitators in running SOAR events and in preparing SOAR reports. By having access to the full SOAR report, Parkland can monitor the progress of each facilitator utilizing SOAR, coach and counsel individual facilitators as may be needed or requested, and validate SOAR events for billing purposes. Parkland also utilizes such information for quality control purposes.
INFORMATION SHARING AND DISCLOSURE
Parkland will NOT disclose the personal information it collects or requires as part of SOAR to anyone outside the Parkland organization at any time. Any industry or other information gained from compilations of SOAR results will not have any specific company information associated with it in order to assure the confidentiality of all SOAR Licensees. Parkland may disclose your personal information to third parties who work on behalf of Parkland to provide products and services requested by you. We will share personal information for these purposes only with third parties whose privacy policies are consistent with ours or who agree to abide by our policies with respect to personal information. Parkland may otherwise disclose personal information when: (1) we have Licensee’s express consent to share the information for a specified purpose; (2) we need to respond to subpoenas, court orders or such other legal process; (3) we need to protect the personal safety of the users of our Website or defend the rights or property of Parkland; or (4) we find that the actions on our Website violate the Parkland’s Terms of Use document or any of our usage guidelines for specific products or services.
